Verdict of kulbhushan yadav The international court of justice has announced the verdict of Kulbhushan Jadhave case today at 6.00 PM according to PST. India took the petition to the ICJ, challenging the death sentence of the Indian spy Kulbhushan.  Justice Abdual Qavi has announced the final verdict of the case in ICJ.

ICJ Rules in favour of Pakistan, ICJ admits Kaboshan is an Indian Citizen & the sentence or the convection of the Kulbhushan Jadhave is not the violation of the Vienna Convention.

Verdict of The Case

  • The ICJ admits Kulbhushan Jadhave as Indian citizen.
  • ICJ rejected Indian plea to set him free from the charges.
  • The ICJ rejected India’s plea to annul the sentence.
  • Additionally, the verdict added that the court request to Pakistan to review the decision of military court.
  • However, the court said that the sentence or the convection of the Kulbhushan Jadhave is not the violation of the Vienna Convention.
  • The ICJ says to immediate grant Kulbhushan Jadhave the counselor access.

However, the verdict can be viewed a winning situation for Pakistan as Pakistan will keep Kulbhushan Jadhave in custody.

Who is Kulbhushan Jadhave

According to Pakistan, he is a serving commander of Indian Navy and associated with the intelligence agency, Research and Analysis Wing (RAW) of India. He was arrested on March 3, 2016, when he was involved in spying for RAW and he has the allegations of espionage and  terrorism in Pakistan. He admitted his involvement in terrorist activities in his confessional statement and sentenced to death by the military court of Pakistan. However, the Indian government denied the allegations and asserted that Kulbhushan is not a spy and he was kidnapped from Iran, and  therefore, India took the case to the ICJ. The case was presented in ICJ in 2017.

Indian Pitition in Kulbhushan Case

India plead its case in ICJ on the basis of two broad grounds. First, India claimed that Pakistan violated Vienna convention as it denied Counselor access to Kulbhushan. Secondly, India questioned the process of the case and claimed that Kulbhushan was not given a fair trial in the military courts of Pakistan. Moreover, Indian claimed that Pakistan violated international law by not allowing India to give diplomatic assistance to Kulbhushan.

Pakistan’s Stance in ICJ

Pakistan has a strong stance in the ICJ against Kulbhushan, an Indian spy. The confessional statement of the spy is the strongest claim by Pakistan. Pakistan has clarified, “Kulbhushan is a spy and cannot be given counselor access according to the Vienna convention. Pakistan provided the proofs of his traveling to Mumbai and Delhi 17 times.

Kulbhushan confessed in front of the Magistrate that he was given a task by RAW for espionage and terrorist activities. The aim of the operation was to destabilize Pakistan and to wage war against Pakistan.
